1. Agreement to these Terms
These Terms & Conditions (“Terms”) govern your access to and use of the THE WIND ERP mobile application (Android package com.thewind.erp) and related services provided by THE WIND Software (“we”, “us”, or “our”).
By downloading, installing, accessing, or using the app, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of the Service
THE WIND ERP is a mobile client for THE WIND ERP, a school and university operations platform. Features may include (depending on your role and institution configuration):
- Parent access to linked student attendance, timetable, homework, results, fees, notices, and leave
- Teacher / faculty tools for attendance, homework, marks, notices, messaging, and leave workflows
- Optional location-assisted school bus / home pickup pin features
Feature availability is controlled by your educational institution and your assigned permissions.
3. Eligibility and accounts
- You must be authorised by a participating school, college, or university to use the app.
- Accounts are typically created or linked by institutional administrators.
- You are responsible for keeping your login credentials confidential and for activity under your account.
- Notify your institution and us promptly if you suspect unauthorised access.
- We may suspend or terminate access if we reasonably believe these Terms have been violated or security is at risk.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to access data or features you are not authorised to use
- Interfere with or disrupt the app, APIs, or related infrastructure
- Reverse engineer, scrape, or misuse the Service except where permitted by law
- Upload malicious code or content that infringes others’ rights
- Share another person’s personal or student information outside authorised educational use
5. Institutional data and responsibilities
Academic and operational records displayed in the app belong to or are controlled by the educational institution that uses THE WIND ERP. Institutions are responsible for the accuracy of student data, user provisioning, and permissions. THE WIND Software provides software and hosting services; day-to-day content decisions (for example attendance marks or fee status) are made by the institution and its staff.
6. Location features
Some features may request device location permission to set a home pickup pin for transport alerts. Providing location is optional. If you deny permission, those specific features may be limited, but other authorised features remain available.
7. Intellectual property
The app, branding, software, and related materials are owned by THE WIND Software or its licensors. These Terms do not transfer ownership to you. You receive a limited, non-exclusive, non-transferable licence to use the app for its intended purpose while your institution maintains an active subscription / authorisation.
8. Third-party services
The app may integrate with or link to third-party services (for example maps or payment gateways configured by an institution). Those services are governed by their own terms. We are not responsible for third-party content or practices outside our control.
9. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of uninterrupted availability, error-free operation, or fitness for a particular purpose. Academic outcomes, fee disputes, and institutional decisions are the responsibility of the relevant school or university.
10. Limitation of liability
To the maximum extent permitted by applicable law, THE WIND Software and its directors, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill arising from your use of the Service. Our total liability for any claim relating to the app will not exceed the amount paid by you (if any) for the mobile app itself in the twelve (12) months before the claim (institutional subscription fees may be governed by a separate agreement).
11. Google Play and device terms
Your download and use of the Android app are also subject to Google Play’s terms and your device manufacturer’s policies. If there is a conflict between those terms and these Terms regarding distribution of the app through Google Play, Google Play’s terms control for that distribution relationship.
12. Termination
You may stop using the app at any time by uninstalling it. We or your institution may suspend or end access if your authorisation ends, fees for the institutional service are unpaid, or these Terms are breached. Provisions that by nature should survive (including intellectual property, disclaimers, and limitations of liability) will survive termination.
13. Changes to these Terms
We may update these Terms periodically. The Effective date above will be revised when changes are published at this URL. Continued use after changes take effect constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of India. Courts in Punjab, India shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.
